All legislators are encouraged to attend a seminar entitled "What Happens in Early Childhood Matters for a Lifetime," to be held on Thursday, September 16, 2010 in Rooms 210,211, Legislative Offices Building, beginning at 9:00 a.m. Sponsored by the Legislative Caucus for Young Children and the House Children and Family Law Committee in collaboration with the National Conference for State Legislatures (NCSL), the seminar will feature Hirokazo Yoshikawa, Ph.D., from Harvard University Center for the Developing Child and Sandra Alexander, Expert Consultant, Division of Violence Prevention, Center for Disease Control and Prevention (CDCP). Dr. Yoshikawa is internationally recognized for his research on the economic and life-long impact of poverty, trauma, exposure to violence, child abuse, chronic neglect and deprivation on young children's development. Sandra Alexander will present information on the CDCP's "Adverse Childhood Experiences Study," which demonstrates links between childhood maltreatment and later life health and well-being. Of special interest to legislators will be the economic analysis of adverse factors and the benefits of policy initiatives that promote positive outcomes for both children and adults. The seminar will include brief respondent panels to both presentations, and following lunch, participants will work in policy groups facilitated by NCSL staff and focused on child safety and well-being, family stability and security, health and education. GOVERNOR'S VETO MESSAGE ON hb 53
By the authority vested in me, pursuant to part II, Article 44 of the New Hampshire Constitution, on July 23, 2010, I vetoed HB 53.
The Right to Know Law plays a critical role in assuring transparency and accountability in the operation of government at all levels. The provisions of the law governing public meetings and access to the records of public bodies and public agencies should be understandable and clear to citizens and officials alike. I am vetoing this bill because it could potentially dilute the public's access to documents and information that constitute governmental records under RSA 91-A.
The existing provisions of RSA 91-A subject "public bodies" to the requirements for open meetings and access to governmental records. "Public agencies" must also provide access to governmental records, but may not be subject to the open meeting requirement depending upon whether such agencies act or vote by agreement of their members.
HB 53 amends the definition of "public body" in an effort to clarify that certain local officials are not public bodies. The bill provides that "an individual executive or administrative officer of a political subdivision shall not constitute a public body, and staff members of an agency or department of a political subdivision meeting as a group shall not constitute a public body."
By explicitly stating that such local officials and employees are not a "public body", the bill creates confusion about the continuing obligation for such local officials and staff to make available their records in accordance with RSA 91-A and would dilute the spirit of the law.
The goal of distinguishing the respective open meeting obligations of public bodies, public agencies and local officials and staff in the Right to Know Law may be a valid one, but any changes to the law for this purpose should be narrowly drawn and must not leave room for any ambiguity or misinterpretation about the existing obligations of public bodies and public agencies to make available their governmental records.

GOVERNOR'S VETO MESSAGE ON hb 379
By the authority vested in me, pursuant to part II, Article 44 of the New Hampshire Constitution, on July 26, 2010, I vetoed HB 379.
HB 379 would create such a new exception to the Right to Know Law by allowing elected officials of a legislative body to meet in non-public session to discuss strategy and negotiation of collective bargaining prior to the time that a collective bargaining agreement is submitted for approval.
The Right to Know Law already allows the public body that negotiates a collective bargaining agreement to confer privately for the purpose of considering strategy and negotiation of the agreement. RSA 91-A:2, I (a) exempts from the public meeting requirement strategy or negotiations for collective bargaining.
The proposed new exception in HB 379 would allow discussions by the body that approves these agreements - that must now occur in public - to be conducted in a non-public session. HB 379 would allow the members of a legislative body that does not negotiate but which must approve a public employee contract - such as a board of alderman - to meet in a non-public session with the public body that negotiates the contract as long as the cost items have not been submitted for approval. As a result, potentially important discussions that are now subject to open meeting could be removed from the public arena.
The Right to Know Law's provisions governing open meetings safeguard transparency and accountability in the operation of government. The threshold for creating any new exception to the open meeting requirement must be very high, and I do not believe the types of meetings contemplated by this bill warrant the creation of another exception.
For these reasons, I am vetoing this bill.

GOVERNOR'S VETO MESSAGE ON hb 1161
By the authority vested in me, pursuant to part II, Article 44 of the New Hampshire Constitution, on July 26, 2010, I vetoed HB 1161.
HB 1161 would repeal the ability of New Hampshire cities and towns to license persons who are engaged in the business of retail sales of firearms.
Since 1991, under RSA 159:8, cities and towns have had the authority to decide whether or not to require individuals who sell pistols, revolvers and firearms at retail to obtain a local license. This license serves several purposes, including identification of retail gun sellers who might not be subject to federal firearms licensing requirements. Current law imposes on retail firearms sellers a requirement to know the identity of the person purchasing a gun, or to obtain clear evidence of their identity, including whether the purchaser has been convicted of a felony.
While other state and federal laws prevent any person in New Hampshire from selling a firearm to a convicted felon, it does not seem necessary to take away the authority of municipalities - authority the state has granted for nearly twenty years - to license local retail sellers of firearms. The New Hampshire Association of Chiefs of Police have raised with me public safety concerns with taking away the local licensing authority, and have strongly urged that this bill not become law. For these reasons, and my view that changes to New Hampshire's gun laws are not needed, I am vetoing this bill.

Governor's Veto Message ON HB 1490
By the authority vested in me, pursuant to part II, Article 44 of the New Hampshire Constitution, on July 13, 2010, I vetoed HB 1490.
The State of New Hampshire has a responsibility to do the very best it can to provide oversight of state regulated financial institutions and protect consumers from fraud. Because this bill moves New Hampshire in the wrong direction, and does not serve the best interests of New Hampshire consumers, I am vetoing it.
HB 1490 would make changes to the Banking Department's jurisdiction over consumer complaints against financial institutions that are inconsistent with the Attorney General's Report concerning Financial Resources Mortgage, Inc. and recommendations for strengthening consumer protections and enforcement.
This legislation extends existing law that provides the Banking Department with exclusive authority and jurisdiction to investigate unfair conduct by regulated financial institutions, but it also purports to expand that exclusive authority to include enjoining violations of the consumer protection laws.
The Attorney General has recommended that the Department of Justice's authority to regulate unfair or deceptive practices in the banking industry that was removed in 2002 should be restored, and I support the restoration of that authority. This bill moves this responsibility in the opposite direction, by granting additional exclusive authority to the Banking Department to enjoin such unfair and deceptive trade practices by financial institutions. Moreover, the bill suggests that the Banking Commissioner will now have authority to appear in Superior Court to enjoin violations while, in fact, it is the responsibility of the Attorney General to enjoin unfair and deceptive trade practices in the courts.
The joint Commerce Committees in the House and Senate held extensive hearings into the Financial Resources Mortgage, Inc. matter, including issues pertaining to the investigation and oversight of consumer complaints of unfair and deceptive practices by state regulated financial institutions. The Joint Committee is due to issue a report and recommendations this fall, and I intend to work closely with the legislature to ensure we restore the authority removed from the Attorney General's office and make other necessary changes to strengthen oversight of financial transactions and financial services.
There are other changes to the banking laws in the bill that will improve financial services oversight, and I will work with the legislature to ensure that those provisions go forward again next session. My veto of this bill will not affect the Citizens Task Force on Revenues and Expenditures, as this provision was also included in Special Session HB 1, which is now law.

The 3rd annual CHaD Seacoast Classic Golf Tournament for the benefit of Children's Hospital at Dartmouth is scheduled for Thursday, September 30th at Cocheco Country Club in Dover. All legislators, legislative staff, state agency staff and general public are welcome to attend a day of golf and fun filled events at this private golf venue. Entry fee to play is $125 per person which includes 18 Holes of scramble style team golf, cart, entry in all contests and meal after. The House Clerk's Office is now accepting orders for the 2010 hardcover Permanent House Journals. Orders will be accepted until Friday, October 22, 2010.
Anyone who was a member of the Legislature in 2010, and all state agencies are entitled to one Journal at no charge, upon request. All others interested in obtaining a Journal, as well as any Legislator or state agency requesting additional copies, will be charged for that copy. We estimate the cost for paid volumes to be approximately $50 each. In addition, if the volume is to be mailed, there will be a $5.00 shipping & handling charge. Those who order paid copies will be notified and billed when the Journals are ready for distribution. DO NOT send any money now.
In an effort to contain costs, the number of Journals printed will be determined by the number of advance orders received. Extra copies will not be ordered. Please do not order a Journal if you have no intention of claiming it.
