A.M. Best Law Podcast Examines Coverage Under Canada’s Insurance Act
A.M. Best Co. has released the 45th episode of the Insurance Law Podcast, a series that examines timely and important legal issues affecting the insurance industry, from an attorney’s point of view.
The latest edition features Attorney David Burstein from the law firm Lang Michener in Toronto, Ontario, discussing Canada’s Insurance Act and an appeal on a coverage matter involving an accident with a parked truck.
Burstein has practiced law in Ontario for more than 20 years. He currently serves as the Chairman of Lang Michener’s Toronto Insurance Litigation Group, where he advises insurers on coverage issues. Burstein also serves as defense counsel in several practice areas, including automobile, personal injury and general liability.
In this edition of the Law Podcast, Burstein shares his insights on Canada’s Insurance Act within the Ontario province as it applies to insurer appeal cases related to injuries arising from automobile accidents. In the featured case, Burstein was able to successfully resolve the appeal of a Toronto pedestrian injured by an unmarked metal pipe protruding from the back of an improperly parked truck. The specific details of this case required the Appeals Court to closely examine the meaning and intention of the phrase “struck by an unidentified automobile” as it is used in Ontario’s insurance laws. Later in the podcast, Burstein shares his personal experience with a similar appeals case involving a death related to an automobile accident.
