MURPHY BILL FOCAL POINT OF COMMISSION REPORT TO COMBAT OPIOID AND ADDICTION CRISIS
Bipartisan group of governors, addiction experts push for action on Murphy's H.R. 3545, The Overdose Prevention and Patient Safety Act to fight America's addiction crisis
Specifically, the report recommends to, "Better align, through regulation, patient privacy laws specific to addiction with the Health Insurance Portability and Accountability Act (HIPAA) to ensure that information about [Substance Use Disorders] be made available to medical professionals treating and prescribing medication to a... patient. This could be done through the bipartisan Overdose Prevention and Patient Safety Act..."
Murphy's OPPS Act modernizes addiction treatment by ensuring doctors have access to their patient's entire medical history. Specifically, it reforms 42 CFR Part 2, known as "Part 2," by subjecting all substance use treatment records used for payment, treatment, or healthcare operation to the requirements of HIPAA. In addition to ending the segregation of substance use records from the rest of the healthcare system, the legislation provides important new protections against the inappropriate sharing of substance use treatment records, which ensures the highest level of privacy is maintained.
