Court upholds dismissal of lawsuits against Pete’s Communication stemming from sexual misconduct allegations

The Court of Appeals affirmed the finding. In a memorandum accompanying the decision, the court described the circumstances surrounding the abuse against the five victims. In all of the cases, employees and others connected with the company did not witness the abuse.
The Court of Appeals did not find any "red flags" that would have led others in the company to respond to possible abuse.
The Court of Appeals also agreed with a District Court finding that Hoagland's "alleged assaults were not within the scope of employment" and that his knowledge of them could not be imputed to the company.
Hoagland is incarcerated at the Minnesota Correctional Facility-Faribault, according to state
