Hagarty raises liability questions over roundabout sculpture

He's asked the city's risk liability committee to determine if insurance would cover any possible damages that might occur on the roundabout due to potential automotive accidents related to the sculpture's presence.
"If a citizen calls up about a cracked sidewalk and we ignore it, they have an opportunity to sue us later if it develops into something more serious," Hagarty said, adding the roundabout sculpture is no different.

"When we put up light poles, should the risk committee look at that too?" Taiber said.
The roundabout sculpture has been criticized by Hagarty and others since it was first proposed last December. Taiber thinks some of the flak has less to do with the sculpture and more to do with where the city's public art committee wants to put it.
"Some people's opposition to the sculpture is correlated to their opposition to roundabouts in general," Taiber said.
Hagarty admitted he falls into that category, and emphasized he is not against public art, but rather the location and associated cost.

Taiber thinks the safety concerns can be addressed during contract with negotiations with Hunt.
"When you go into any kind of project like this you're going to design it to accepted engineering standards," Taiber said. "Sculptures can be accommodated in the middle of a roundabout. It happens all around the country and all around the world.
"Public art is going to be emotional and opinionated no matter what," Taiber said.
