CCC Calgon Carbon confirms it received an adverse verdict (13.46 -0.15)
Co received an adverse verdict from the United States District Court for the Western District of Pennsylvania in Calgon Carbon Corp. v. ADA-ES (ADES). The jury awarded ADA-ES $12.0 mln consisting of $3.0 mln for past and $9.0 mln for future damages. The litigation concerned a contract awarded to Calgon Carbon in March of 2008 by a major U.S. power generator for the supply of powdered activated carbon for the removal of mercury from flue gas. Calgon Carbon disputed ADA-ES's claim that it had earned a commission for the contract based on a memorandum of understanding between the two companies that was terminated in August of 2007.

Noted in the 11:40 update that the aggressive intraday reversal had reached a support in the 1097/1095 area and would be watching for a stabilization near this zone or after one more extension. We did see the extension which met a Fibonacci Extension target at 1093 with a minor lift off the low noted thus far (Click for chart). Confirmation will be needed but from a wave perspective it is possible to consider the 1120 to 1092 decline as a complete three wave consolidation.
