This bill will have several effects on the bail bonding process, mostly in the area of bail enforcement.
This bill states that the “Bureau of Criminal Investigation” or BCI “is required to act on renewal applications for bail recovery, bail enforcement, and bail apprentice licensing issues.”
It will also mandate that the “Bail Bond Recovery Licensure Board will process renewal applications for bail recovery, bail enforcement, and bail apprentice licensure that do not meet the renewal requirements.” This ensures that all applications are fully processed regardless of whether they meet the necessary requirements.
This will also make it so that bail bond enforcement agents don’t have to wear identifying clothing as long as they properly display their badge and bail enforcement license. This will assist in the apprehension of potential bail jumpers.
If the bail enforcement agent is in the process of a planned apprehension, they must wear identifying clothing in addition to their badge. This will help in the identification of the bail enforcement agent by police and officials.
If a bail enforcement agent comes across a peace officer in the process of a planned apprehension, they must show identification to the officer.
This bill will have numerous clauses and provisions, and like any other bill will have negative and positive impacts on the bail bond industry. To read the bill in its entirety, check it out here: http://le.utah.gov/~2013/bills/hbillenr/HB0386.htm.
