Dumpster ordinance formally adopted in Gilberton

The vote to advertise the ordinance (2014-2) was held at the April meeting after borough council discussed the matter during the two previous meetings. Issues discussed were the long amount of time some trash containers sat at a property, which caused damage to streets. The delivery and removal of the Dumpsters and waste receptacles could also cause damage to streets. Another issue is having a trash container on the street during the winter, causing difficulties for snow plowing.
According to the ordinance, a waste Dumpster is "a unit designed or used for the deposit of waste materials at a building, commonly located on a temporary basis on a highway" near the site. It also includes "any receptacle used as a waste Dumpster, including truck beds."

There are 12 placement and use regulations, including:
- The trash container will not extend into the travel lanes of a street or highway, must have reflective markings in visible locations to provide reasonable warning to nighttime traffic and should not be a safety hazard.
- The trash container's location will be in compliance with all other federal, state and local statutes, rules and regulations that apply.
- Each of the trash container's rollers or wheels, if any, must be placed on a wood pad at least 3/4-inch thick in order to not damage the road surface.
- The person (permittee) obtaining the trash container will provide a copy of the waste hauler's certificate of insurance listing
- Only one Dumpster per property will be permitted at a time. The trash container will have the owner's name, address and telephone number.
- If a chute or similar object is constructed to be used with a waste Dumpster, it must be deemed structurally sound by the borough and an insurance liability certificate must be provided.
