Centralia Gears Up for Legal Pot Battle

The Chronicle made a formal documents request to the city on Friday, but the city says it has yet to receive a bill from either attorney.

"There's no guidelines on this topic," Murphy-Olson said.
The city was served papers Tuesday, but has yet to receive a court summons. Murphy-Olson wouldn't discuss specifics, but she said the city was served paperwork in such a way that it might make request to be reserved. That could buy extra time for the city.
"It's a little rough, (the serve) wasn't perfected and that's an issue we're talking about," she said. "When there's an irregularity with service, the remedy is to reserve."

In essence, Hallock is questioning the city's ability to invoke federal law while simultaneously invoking local law. She views the moratorium as a de facto ban that can be argued away as a violation of civil procedure.
"We're asking if a locality can ban something that's legal at the state level but illegal at the federal level," she said. "I don't think you can invoke your local police powers for land use and invoke a federal statute at the same time."
