The Plaintiff was injured in November of 2011 while working on the job, according to court documents, and although she was still physically unable to work a month later, she was terminated after repeatedly failing to update her employer on her status. The Plaintiff argued that she had indeed reported to the company and claimed she had cell phone records of approximately 30 phone calls to her employer within the month.
Defense counsel explained that she failed to report to the proper representative and did not follow company policy for treating her injuries, providing good cause for termination. According to court documents, the defense also emphasized that an employee's inability to follow company policy is representative of her inability to comply with Federal Motor Carrier Regulations, and ultimately poses a serious danger to more than just the employer.
The jury determined that the trucking company did not discharge the Plaintiff as a result of her Workers' Compensation claim, and that other factors led to her termination, rendering a complete defense verdict for the trucking company.
