Rodriguez said he did not want to talk unless he had a lawyer and he refused to let the trooper check his eyes, the affidavit stated.
The affidavit then stated that the trooper believed Rodriguez was driving while intoxicated prior to the crash.
Rodriguez was read the DIC 24 Statutory Warning and asked to provide a specimen of blood, to which he refused and then asked for a lawyer, according to the affidavit. Under Transportation Code chapter 724 subchapter B, if an individual is involved in a crash that is reasonably believed to be a result of a suspect's intoxication, he or she is required to provide a blood specimen.
