The report, filed in
As part of the accompanying search warrant, the District Attorney General's office seized financial records in conjunction with the second set of charges announced
"While I have begun to examine the records in possession of the District Attorney General pursuant to the Court's Order," Kustoff wrote, "I have not yet had an opportunity to examine whatever data that might exist on the computer's hard drive."
Kustoff added that there were "few bank statements and no tax returns" seized under the search warrant. As part of investigating Galilee's financial status, the state has issued subpoenas for a number of banks and funeral homes regarding their dealings with the cemetery.
Kustoff said when he went to the cemetery office on the south end of the property after execution of the search warrants, the records were "unorganized and in disarray."
Meanwhile, the state also is resisting a request by two local legal teams pursuing class action status in lawsuits filed on behalf of family members whose relatives are buried at Galilee.
The order states that no complaint or countercomplaint can be "initiated or continued" against the cemetery without the court's permission. Both groups believe they should be able to pursue their cases. The state counters that such actions would hinder work at Galilee.
A hearing is scheduled for Friday in
"The Receiver and the Deputy Receiver understand that many family members want answers to the questions of how and where their loved ones are buried," the state wrote in opposing the requests. "Understanding the urgency of the situation, the Receiver and the Special Deputy Receiver assure this Court and other interested persons that they are hard at work."
