Attorney Jon Saia Gets Client Dismissed and Acquitted of OVI and Weapons Charges

According to court records, Attorney Saia's client was facing charges following an incident in which he was found asleep at the wheel after getting a flat tire. The client was woken up by a law enforcement officer. While the man was searching for his driver's license, the officer saw a handgun in his vehicle console, according to court documents.
The records show that the officer then tried to get the man to participate in OVI testing to determine whether he was operating a vehicle while under the influence of alcohol or drugs. The man refused to submit to standardized field sobriety tests, though he was later given a blood test due to the issuance of a search warrant. Court documents state that the blood test results indicated that the man's blood alcohol concentration was 0.134%, which is well above the legal limit of 0.08%. As a result of this incident, the client was indicted with two counts of OVI and two counts of improper handling of a firearm.
According to court records, Attorney Saia advocated for his client in pre-trial motion hearings and one OVI charge and one weapons charge were dismissed. The lawyer went on to present the client's defense before a jury.
