Dec. 14--A Shenandoah man shot by police following a retail theft and high speed chase on Aug. 26 is among those scheduled to plead not guilty Monday during arraignment in Schuylkill County Court.

John A. Pino, 70, of 309 E. Centre St., Apt. C, was arrested by state police Trooper Melissa Kyper of the Frackville station and charged with aggravated assault on police, simple assault, recklessly endangering another person, resisting arrest, fleeing or attempting to elude police, failure to yield on approach of emergency vehicles, turning movements and required signals violation, careless driving, failure to drive on roadways laned for traffic, limitations on driving on the left side of the road, limitations on overtaking on the left, accidents involving damage to attended vehicles or property, failure to give information and render aid, limitations on backing, reckless driving and driving at an unsafe speed.

In a separate complaint, Pino will enter a plea on charges of retail theft filed by Saint Clair police Patrolman Chad Seitzinger stemming from the theft at Wal-Mart that prompted the chase.

Kyper said police were on the lookout for Pino's vehicle after the theft, and he failed to stop for state police, who saw him driving north on Interstate 81 between the Frackville and Mahanoy City exits.

Pino exited onto Route 54 east and then turned around at the Ryan Township Fire Company to travel back toward the interstate.

With state and local police officers in pursuit, Pino drove into the lanes of oncoming traffic on Route 54 and continued onto White Owl Drive in Mahanoy Township. A police officer forced his SUV off the road, where it became stuck. After refusing to get out of his vehicle and trying to get it unstuck, which endangered police, Pino was shot and taken to custody.

Others scheduled to plead not guilty, and the charges against them, include:

Alyssa Bensinger, 25, of 24 Hunter St., Tamaqua -- simple assault and retail theft.

Danielle M. Fulton, 25, of 235 Brown St., Tamaqua -- theft of property lost, mislaid or delivered by mistake, theft and receiving stolen property.

Gary D. Updike, 36, of 128 S. Oak St., Mount Carmel -- aggravated indecent assault of a child, aggravated indecent assault, indecent assault and corruption of minors.

Thomas E. Fronczak, 43, of 115 Lower St., Morea, Mahanoy City -- DUI, resisting arrest, failure to be licensed and driving while operating privileges are suspended or revoked.

Patrick R. Ellison, 30, of 127 E. Third St., Box 287, Minersville -- retail theft, receiving stolen property, defiant trespass, stop and yield sign violations and driving while operating privileges are suspended or revoked.

Clifford Behler, no age available, of 712 Centre St., Third Floor Apt., Ashland -- simple assault, resisting arrest and false reports to law enforcement.

Fungai M. Mugwindri, 40, of 233 Race St., Tamaqua -- terroristic threats and simple assault.

Owen M. Berezwick, 39, of 7 S. Fifth St., Barnesville -- DUI, DUI-highest rate, violation of general lighting requirements and driving on the wrong side of the road.

Richard C. Frick, 58, of 240 E. Broad St., Apt. 4, Tamaqua -- delivery of a controlled substance, possession with intent to deliver a controlled substance, possession of a controlled substance, possession of a small amount of marijuana and criminal use of a communications facility.

Leroy J. Manhart, 44, of 475 High Road, Ashland -- criminal trespass, aggravated assault with a deadly weapon, simple assault and simple trespasser.

James A. Whitman, 23, of 921 Brock St., Ashland -- simple assault.

David M. Riedel, 31, of 411 E. Main St., Girardville -- corruption of minors.

Gavin D. Heim, 19, of 329 Park Road, Valley View -- manufacture of a controlled substance, possession with intent to deliver a controlled substance, possession of drug paraphernalia and flight to avoid apprehension, trial or punishment.

Brandon M. Heisey, 30, of 36 N. Lehigh Ave., Frackville -- rape, sexual assault, indecent assault, indecent exposure and simple assault.

Charles E. Wishnefsky, 22, of 30 W. Laurel St., Shenandoah -- aggravated assault, simple assault, recklessly endangering another person, harassment and disorderly conduct.

Joseph F. Temple, 49, of 132 Centre St., Ashland -- DUI, driving while operating privileges are suspended or revoked and illegal use of multi-beam road lighting equipment.

Ryan L. Seigel, 27, of Schuylkill County Prison, Pottsville -- possession of a controlled substance and possession of drug paraphernalia.

James A. Lemmon, 40, of 505 E. Grand Ave., Tower City -- fleeing or attempting to elude police, endangering the welfare of a child, driving while operating privileges are suspended or revoked, driving without insurance, reckless driving and stop and yield sign violations.

Sean P. Cooke, 22, of 312 S. Jackson St., Pottsville -- possession of a small amount of marijuana and possession of drug paraphernalia.

Chelsea A. Ciccanti, 26, of 17 W. Franklin St., Saint Clair -- delivery of a controlled substance, possession with intent to deliver a controlled substance, possession of a controlled substance, possession of drug paraphernalia and resisting arrest.

Juanita L. McCabe, 37, of 206 E. Ogden St., Apt. 2B, Girardville -- possession of a small amount of marijuana.

Justin T. Kanezo, 20, no known address, Pottsville -- burglary, theft and receiving stolen property.

Brian S. Fritz, 37, of 335 Hazle St., Tamaqua -- DUI.

Angel Anthony Resto, 21, of 62 Hunter St., Tamaqua -- rape of a child, unlawful contact or communications with a minor, statutory sexual assault, indecent assault, indecent exposure and corruption of minors.

Joseph J. Forster, 35, of 307 Market St., Tamaqua -- driving under the influence of drugs and possession of drug paraphernalia.

Timothy Lee Bressler, 47, of 516 S. Centre St., Pottsville -- possession of drug paraphernalia.
