Tropical Storm Debby
After stalling off Florida’s Gulf Coast most of the weekend, Tropical Storm Debby finally made landfall on Tuesday, May 26, near Steinhatchee. Tropical-storm warnings were in effect for 450 miles of coastline, from Mexico Beach in the Panhandle, to Englewood, south of Sarasota. By Tuesday afternoon, a State of Emergency had been declared for the entire state of Florida. By Wednesday, an estimated 35,000 homes and businesses had lost electricity, and flooding had been reported in low-lying coastal areas, and along rivers creeks in streams. According to a Reuters report, some places in the northeastern part of Florida received more than two feet of rain. Emergency managers in Pasco County on Florida's central Gulf Coast ordered a mandatory evacuation for 14,000 to 20,000 people living between the Anclote and Pithlachascotee Rivers due to high water. The storm spawned scores of tornadoes that caused severe damage to homes throughout Florida. While it is too early to begin to place a dollar figure on the destruction caused by Debby, thousands of Florida residents and businesses will likely file damage claims with their insurers in the coming days. Already, Citizens Property Insurance has reported receiving just over 1,500 claims, a figure its CEO said “could well be just a drop in the bucket." Most claims so far involve wind and roof damage, and have come from Florida’s west coast counties of Hernando, Hillsborough, Pasco and Pinellas, as well as the greater Tampa Bay region. According to Gilman LLP, most Florida property owners assume their insurer will pay their damage claims in return for the hefty premiums they are often assessed. But past experience has shown that insurance companies often find ways to deny or lowball tropical storm damage claims, for instance by stating that the damage was pre-existing or caused by flooding not covered under the policy. Property owners faced with damage from Tropical Storm Debby should seek the help of an attorney experienced with hurricane and tropical storm claims to ensure their interests are protected.
