Indictments (Jan. 3) [Las Cruces Sun-News, N.M.]

Jan. 03--The following indictments were handed down by a Dona Ana County grand jury Dec. 22:

--Aaron Lee Barela, 36, 1145 Monte Vista, Apt. 3, Las Cruces, is charged with aggravated fleeing an officer, resisting arrest, aggravated drunken driving, failure to maintain traffic lane, driving with a suspended license, possession of an open container of alcohol in a vehicle and no insurance on Oct. 27. Barela allegedly crashed into a park before fleeing on foot; his breath-alcohol content was measured at .19 and .17, more than twice the legal limit, and two open containers of alcohol were found in his car, according to court documents.

--Daniel Lawrence Boyle, 54, of Las Cruces, is charged with non-residential burglary and larceny on Dec. 11, 2011. Boyle allegedly took a bottle of liquor from Albertsons grocery store, according to court documents.

--Gracie Cardon Garcia, 57, 2206 S. Mesquite St., Las Cruces, is charged with aggravated drunken driving (three prior convictions), driving with a suspended license, improper turning at intersection, no evidence of registration, no insurance and tampering with an ignition interlock device on Oct. 26. Garcia's breath-alcohol content was allegedly .21 and .20, two and a half times the legal limit, an ignition interlock device inside the car was not functional and she appears to have an outstanding warrant from Oregon for drunken driving, according to court documents.

--Serio D. Gonzales, 28, 2803 Borroughs St.,

Las Cruces, is charged with forgery on Aug. 7. Gonzales, a Dona Ana County Detention Center officer, allegedly forged a woman's name on the title of a vehicle that was being sold, according to court documents.

--Alejandro M. Guillen, 24, 2020 Garrison St., Las Cruces, is charged with giving alcoholic beverages to a minor and contributing to the delinquency of a minor on Oct. 15. Guillen allegedly bought alcohol for four 18- and 19-year-olds and one juvenile, according to court documents.

--Vanessa Hall, 25, 6330 Chula Vista, Las Cruces, is charged with aggravated battery against a household member with a deadly weapon and assault against a household member on Nov. 6. Hall was allegedly intoxicated when she became argumentative and combative with her husband when he tried to stop her from continuing to drink, and when he tried to leave the home, she allegedly threw a bottle of wine at him, followed him outside and threw a large rock at him, slicing his forehead, according to court documents.

--Dung Quoc Huynh, 32, homeless, is charged with embezzling a motor vehicle on Dec. 10. Huynh allegedly stole a rental vehicle from Tucson, Ariz. and was living in it, according to court documents.

--Ricardo L. Jordan Jr., 27, of Mesquite, N.M., is charged with felony cocaine possession on April 17. Jordan was allegedly found with .5 grams of cocaine, according to court documents.

--Roberto "Beto" Lopez, 49, 421 First St., Sunland Park, is charged with trafficking cocaine, possession of drug paraphernalia and possession of marijuana on Sept. 23. Lopez was allegedly found with 10.4 grams of cocaine and 4.4 grams of marijuana, in addition to a digital scale, sandwich bags and rolling papers, according to court documents.

--Randy Manning, 20, 8628 N.M. 478, Vado, is charged with burglary of a vehicle and conspiracy on Dec. 9. Manning and another person allegedly took a flat-screen television in the back of a truck belonging to the Las Cruces Police Department, which was parked at the Mesilla Valley Mall, according to court documents.

--Orlando S. Mendez, 18, 8397 Diamond Circle, Las Cruces, is charged with two counts of aggravated assault with a deadly weapon and one count of criminal property damage on Nov. 7. Mendez allegedly crashed into the victim's vehicle repeatedly, causing more than $1,000 in damage, according to court documents.

--Delfino Miranda Morales, 46, 5130 Isaacs Lane, Las Cruces, is charged with aggravated drunken driving (three prior convictions), driving with a suspended license, no insurance, no evidence of registration and possession of an open container of alcohol in a vehicle on Oct. 16.

--Norma Ramirez, 41, 513 Paloma Blanca Drive, Chaparral, N.M., is charged with felony cocaine possession on Sept. 22. Ramirez was allegedly found with .03 gram of cocaine, according to court documents.

--Roberto Juan Varela, 35, 1630 Rio Grande St., Las Cruces, is charged with trafficking cocaine on Nov. 12. Varela, a teacher at Loma Heights Elementary, allegedly sold cocaine to an undercover Metro Narcotics agent, according to court documents.

--Davon Nigelique Wilkins, 25, 2121 Windy Mill Road, Apt. 1113, Marietta, Ga., is charged with possession of more than eight ounces of marijuana and possession of drug paraphernalia on Dec. 8. The drugs were allegedly discovered at a Border Patrol checkpoint on Interstate 25, according to court documents.

For Clients with Prostate Cancer

--Jimmie Raye Williams, 33, 712 E. 1st St., Truth or Consequences, is charged with fraud by worthless check on April 2, 2010. Williams allegedly passed a worthless check of almost $1,300 to a local transmission shop, according to court documents.

An indictment or criminal complaint is only an accusation. All criminal defendants are presumed innocent in a court of law until proven guilty beyond a reasonable doubt.
